que4.org and Associated Applications

1. Acceptance of Terms

By accessing or using the website located at que4.org (the “Website”), the que4 application available on the Apple App Store for iPhone and iPad (“iOS App”), the que4 channel or application available on Roku devices (“Roku App”), and any related services (collectively, the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including visitors, registered users, and users of the iOS App and Roku App. Use of the iOS App is also subject to Apple’s App Store Terms of Service. Use of the Roku App is also subject to Roku’s applicable terms and policies.

2. Description of Service

que4 provides digital services and features through its Website, iOS App, and Roku App. The specific features, content, and functionality of the Service may change from time to time. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. Eligibility and Accounts

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service. If you are under 18, you may use the Service only with the consent of a parent or legal guardian.

Certain features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to update it as necessary.

4. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to any part of the Service or related systems;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Upload or transmit viruses, malware, or other harmful code;
  • Harass, abuse, or harm other users;
  • Reverse engineer, decompile, or disassemble any part of the Service, except to the extent permitted by applicable law.

5. Intellectual Property

The Service, including all content, software, trademarks, logos, and materials, is owned by que4 or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

You retain ownership of any content you submit to the Service. By submitting content, you grant que4 a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and improving the Service.

6. Third-Party Services and Platforms

The iOS App is distributed through the Apple App Store and is subject to Apple’s standard end-user license terms. Apple is not responsible for the Service or any claims related to it. The Roku App is distributed through the Roku Channel Store and is subject to Roku’s terms. que4 is solely responsible for the Service and its content.

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party services.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUE4 AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

In no event shall our total liability exceed the amount you paid to us (if any) for the Service in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless que4 and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive.

11. Changes to Terms

We may update these Terms from time to time. We will post the revised Terms on the Website and, where appropriate, notify you through the Service. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or the Service shall be resolved in the state or federal courts located in Cook County, Illinois, and you consent to the exclusive jurisdiction of such courts.

13. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver. These Terms constitute the entire agreement between you and que4 regarding the Service.
